Terms of Use

Plain-language summary: you keep your code and own your content; the AI output is yours to check; be decent to others; subscriptions renew until cancelled; the Service is provided “as is.” These Terms should be reviewed by qualified counsel and completed with your legal-entity and governing-law details before you rely on them.

These Terms of Use (“Terms”) govern your access to and use of The Termi Protocol application, websites and related services (the “Service”). By using the Service or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

The Termi Protocol is a 3D AI agent workspace. It provides a visualization and workspace layer around AI coding tools you connect yourself. We do not provide the AI model. You bring your own key (BYOK) or run a local model. The Service is under active development and ships in chapters (“Protocols”); features described as planned may change, slip or be removed.

2. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) and able to form a binding contract to use the Service.

3. Your account & acceptable use

You must provide accurate information, keep your credentials and API keys secure, and you are responsible for activity under your account. You agree not to:

use the Service for unlawful, harmful, or infringing purposes;
attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or others’ data;
abuse automated/bot traffic, or circumvent our security or rate limits;
misuse social or multiplayer features (planned London/Moscow protocols) to harass, abuse, or impersonate others;
violate the terms of any AI provider you connect.

4. Your content & code

You retain all rights to your code, files and content. We claim no ownership over them, and — consistent with our local-first design — we do not access or store them. You are solely responsible for your content and for backing it up.

5. AI output

Code and content generated by AI agents may be inaccurate, insecure or unsuitable. You are responsible for reviewing, testing and deciding whether to use any AI output. The Service visualizes a process; it does not guarantee correctness.

6. Subscriptions, billing & refunds

Some features are offered as paid plans (e.g. Pro, Team). Payments are processed by our provider Creem; by subscribing you also accept Creem’s terms. Unless stated otherwise:

Plans are billed in advance on a recurring basis and renew automatically until you cancel;
you can cancel at any time, effective at the end of the current billing period;
prices and plan features may change with notice for future periods;
where required by law (e.g. EU/UK/Türkiye consumer rules), you may have statutory cancellation/refund rights; outside those, payments are generally non-refundable.

Taxes may apply depending on your location.

7. Leaderboard & public profile

If you sign in, your chosen username, avatar, level/league and ranking may be displayed publicly on the leaderboard. Don’t use a username or image that is offensive or infringes others’ rights. You can request removal from the public leaderboard by contacting us.

8. Third-party providers

Your use of any connected AI provider (Anthropic, OpenAI, Google, Groq, Ollama, etc.) is subject to that provider’s terms and pricing. Any costs you incur with a provider are your responsibility.

9. Intellectual property

The Service, including its software, 3D assets, designs, and the “Termi Protocol” name and marks, is owned by us and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service as intended.

10. Beta & disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or code, arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or any third-party rights.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination, sections that by their nature should survive (e.g. IP, disclaimers, liability, indemnity) will survive.

14. Changes

We may update these Terms as the Service evolves. Continued use after changes take effect constitutes acceptance. Material changes will be reflected by the “Last updated” date above.

15. Governing law

These Terms are governed by the laws of [GOVERNING JURISDICTION — e.g. Türkiye], without regard to conflict-of-laws rules, and the courts of [VENUE] have jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.
